What Is the 491 Visa?
The 491 visa (Skilled Work Regional Provisional visa) lets eligible skilled workers and their families live, work and study in designated regional areas of Australia for 5 years. After completing 3 years in a regional area, holders can apply for the permanent 191 visa (Permanent Skilled Regional)
The subclass 491 visa adds 15 points to your skilled migration score through state/territory nomination or family sponsorship — making it the most accessible pathway for applicants whose points score falls short of the 189 visa or 190 visa invitation threshold.
Applicants must be nominated by an Australian State or Territory government agency, or sponsored by an eligible family member living in a designated regional area, and invited to apply after submitting an EOI in SkillSelect.
The 491 visa replaced the former subclass 489 visa. It is a points-tested visa with a 45-year age limit at the time of invitation, and it requires a positive skills assessment in a nominated MLTSSL or STSOL occupation.
The subclass 489 visa is now closed to new applicants. Transitional arrangements apply for applications already lodged and for applicants on the 489 pathway to the 887 visa.

491 Visa Conditions and Regional Living Requirements
The 491 visa grants a 5-year provisional visa subject to condition 8579, which requires holders to live, work and study only in designated regional areas of Australia for the full visa period. Key conditions include:
- You must live and work in a regional area — you can move between regional areas freely
- Regional Australia means any area outside Sydney, Melbourne and Brisbane — Perth and the Gold Coast qualify as regional areas
- You can work in any occupation for any employer within the regional area
- You cannot apply for most other skilled visas in Australia unless you complete at least 3 years in a designated regional area, except in exceptional circumstances
- Sponsor non-compliance — for the family-sponsored stream — can negatively affect your visa, as with other sponsored visa programs

After holding the subclass 491 visa for at least 3 years and complying with all visa conditions, you can apply for the 191 Permanent Skilled Regional visa. Effect on the 489 Visa to 887 Visa Pathway
The Skilled Regional (Provisional) visa (subclass 489) is closed to new applicants. The Department put transitional arrangements in place for applications already lodged and undecided, and for applicants whose pathway targets the permanent 887 visa (Skilled Regional). 491 Visa Family Stream — Sponsorship by an Eligible Relative
The 491 visa family stream lets eligible relatives sponsor you to live and work in a regional area. For this stream, your nominated occupation must appear on the MLTSSL. Your sponsor must:
- Be 18 years of age or older
- Usually reside in a designated regional area of Australia
- Be an Australian citizen, Australian permanent resident or eligible New Zealand citizen
- Be your or your partner’s eligible relative
Eligible relatives who can sponsor you include:
- a parent
- a child or step-child
- a brother, sister, adoptive brother, adoptive sister, step-brother or step-sister
- an aunt, uncle, adoptive aunt, adoptive uncle, step-aunt or step-uncle
- a nephew, niece, adoptive nephew, adoptive niece, step-nephew or step-niece
- a grandparent, or
- a first cousin
Sponsorship approval must be in place before the Department can grant your subclass 491 visa — the Department will not grant the visa until your sponsor is formally approved.

Do the Sponsor and Applicant Need to Live in the Same State?
There is no requirement for the sponsor and applicant to live in the same state or even the same regional area. However, your sponsor must continue to meet all sponsorship requirements they agreed to — regardless of where either of you lives. If your sponsor moves or their circumstances change, this may affect your 491 visa conditions.
Skills Assessment Requirement for the 491 Visa
You must hold a suitable skills assessment in your nominated occupation at the time of invitation — not just at lodgment. You must declare you hold a valid assessment when you receive your invitation, and provide a copy with your application.
For medical practitioners, the following serve as proof of a skills assessment:
- Full, unconditional or general medical registration with the Australian Health Practitioner Regulation Agency (AHPRA)
- Conditional specialist registration with AHPRA — allowing you to practise in your speciality only, with no further training or supervision required
For legal practitioners:
- Admission to practise law in the relevant Australian state or territory
Your skills assessment must be no more than 3 years old at the date of your invitation — if the assessment was issued for a shorter validity period, that period must not have expired. If your assessment is based on an Australian qualification obtained while you held a student visa, the qualification must come from a CRICOS-registered course.
